Terms
The terms we work to, in plain English.
Using this site and the text messages we send. Client work is covered by our Master Services Agreement.
Who we are and what these terms cover
These terms cover two things: your use of our websites and the text messages we send. By using the sites or giving us your number, you agree to them. If you do not agree, please do not use the sites.
Text messages (SMS terms)
- Booking messages: replies to your enquiry, booking confirmations, appointment reminders and rescheduling. You receive these when you give us your number on one of our forms or booking pages, or text us first, because the number was given so we could contact you about your booking.
- Marketing messages: occasional offers and news about our services, which may be sent using automated technology. You only receive these if you ticked the marketing box on our form. The box is never ticked for you, and you do not have to tick it to enquire, book or buy anything.
Using our websites
You may browse the sites, share links to them and print or save pages for your own reference. You must not:
- use the sites for anything unlawful, fraudulent or harmful;
- try to gain unauthorised access to the sites, the servers they run on or any connected system, or introduce viruses or other malicious code;
- attack the sites with a denial-of-service or similar attack, or interfere with how they work;
- scrape, copy or harvest content or data from the sites by automated means, including to train machine learning models, without our written permission;
- submit forms using someone else's details, or details you do not have permission to give us.
The design, text, graphics, code and other content of the sites belong to us or our licensors. Apart from the uses allowed above, you may not copy, reproduce or republish them without our written permission.
Content on the sites, including case studies, articles, prices and figures, is general information about our work. It is not professional, legal, financial or tax advice, and you should not rely on it as such. Results we describe for clients illustrate past work and are not a forecast or a guarantee of what any business will achieve. We try to keep the content accurate and current but do not promise that it is complete, correct or up to date, or that the sites will always be available or free of errors.
Where the sites link to other websites, those links are for convenience. We do not control those sites and are not responsible for their content or how they handle your data.
If you send us a review or testimonial, you allow us to publish it, with your name, business and role as you gave them, on our sites, social channels and sales material. We only ever publish reviews that are genuine, and you can ask us to take yours down at any time.
Our liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, nothing in these terms affects your statutory rights.
Subject to that, we are not liable for any loss or damage arising from your use of, or inability to use, the websites or our text messages, or from relying on any content on the sites, whether in contract, tort (including negligence), breach of statutory duty or otherwise. In particular we are not liable for loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss.
Our liability to clients for services is dealt with solely in the Master Services Agreement.
General
If a court finds any part of these terms unenforceable, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. No one other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
These terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes and claims), are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living elsewhere in the UK, you may also bring proceedings in the courts of the part of the UK where you live.
We may update these terms from time to time, and the date below will change when we do. If a change to the text message terms materially affects you, we will tell you before it takes effect, and you can reply STOP if you do not want to continue.
